September 2017 Indictments

The Lawrence County grand jury met for the September session this week. Among the indictments returned were 2 different individuals charged with sex crimes, one with 22 charges. Meth charges once again the center of attention as the drug ravages the Lawrence County community.

Here are the indictments handed up by the Lawrence County grand jury:

Horn Willis G. Willis Horn, 27 of Inez, KY. Indicted on the charge of TRAFFICKING IN A CONTROLLED SUBSTANCE, 1st degree (class C felony) by knowingly and unlawfully being in possession of a controlled substance with the intent to traffic in that CS or by trafficking in a controlled substance, namely methamphetamine, scales and baggies on or before May 18th, 2017. The defendant was also indicted on POSSESSION OF DRUG PARAPHERNALIA (class A misdemeanor) for possessing 29 syringes.

 

 

 

 

 

 

 

Donald K. HarrisDonald Harris, 36 of Louisa, Ky. Has been charged by the Grand Jury for POSSESSION OF A CONTROLLED SUBSTANCE (class D felony) on or before June 17th, 2017, Mr. Harris knowingly and unlawfully possessed a controlled substance, methamphetamine.

 

 

 

 

 

 

 

Shannon JudeShannon Jude, 41 of Louisa, KY. The Grand Jury charges that on or before July 7th, 2017, Mr. Jude acted alone or in complicity with others committed the offense of POSSESSION OF A CONTROLLED SUBSTANCE, 1st degree (class D felony) by knowingly and unlawfully committing the offense of possessing methamphetamine, The defendant acting alone or with others also committed the offense of USE/POSSESSION OF DRUG PARAPHERNALIA by knowingly and unlawfully being in possession of an altered pipe, digital scales, 4 syringes, a baggie with chemical residue and two spoons with chemical residue.

The Grand Jury charges that on or before July 7, 2017 the defendant acting alone or in complicity with others committed the offense of possession of a controlled substance in the 1st degree (class D felony) by knowingly and unlawfully possessing a controlled substance, methamphetamine. The defendant acting alone or in complicity with others also committed the offense of use/possession of drug paraphernalia by knowingly and unlawfully possessing an altered pipe, digital scales, 4 syringes, a baggie with chemical residue and two spoons with chemical residue.

The Grand Jury charges that from or about August 26, 2017 the defendant committed the offense of CRIMINAL POSSESSION OF A FORGED INSTRUMENT in the 2nd degree by knowingly and unlawfully with the intent to defraud, deceive or injure another, Utters or possesses a fraudulent title for a Chevrolet pickup truck, The defendant committed the offense of THEFT BY DECEPTION OVER $500 by knowingly and unlawfully obtaining property by deception with the intent to deprive Big Blue Auto Sales of Louisa of a 2000 Jeep Wrangler valued at $3,300, by failing to disclose unknown lean adverse claim or illegal impediment to the enjoyment of property which one transfers.

 

 

 

 

 

 

Seth RigsbySeth Rigsby, 25 of Martha, KY. The Grand Jury charges that on or before March 1, 2017 the defendant committed the offense of POSSESSION OF A CONTROLLED SUBSTANCE IN THE 1st degree by knowingly and unlawfully being in possession of a controlled substance, methamphetamine. The defendant was charged for committing the offense of POSSESSION OF DRUG PARAPHERNALIA by knowingly and unlawfully possessing a metal spoon with chemical residue, a measuring utensil with chemical residue and a syringe.

 

 

 

 

 

Crystal G. WheelerCrystal Wheeler, 40 of Louisa, KY. The Grand Jury charges that on or before May 8, 2017 the defendant acting alone or in complicity with others committed The offense of TRAFFICKING IN A CONTROLLED SUBSTANCE in the 1st° first offense (class C felony) by knowingly and unlawfully being in possession of a controlled substance with the intent or by trafficking in that controlled substance, namely methamphetamine, while he/she was in possession of a Taurus brand 9 mm handgun.

Crystal Wheeler, 40 of Louisa also indicted on: Grand Jury Charges That On or before May 31st, 2017 the defendant acting alone or in complicity with Ashley horn committed the offenses of: 1. TRAFFICKING IN A CONTROLLED SUBSTANCE in the 1st degree by knowingly and unlawfully possessing a controlled substance with the intent to traffic namely, methamphetamine. (class C felony)  2. The defendant committed the offense of TRAFFICKING IN A CONTROLLED SUBSTANCE in the 2nd degree (class D felony) by knowingly and unlawfully possessing a controlled substance with the intent to traffic namely, Suboxone.  3. The defendant committed the offense of POSSESSION/USE OF DRUG PARAPHERNALIA by being in possession of syringes, and altered spoon and several cut and altered straws. 4. The defendant being charged with POSSESSION OF MARIJUANA by knowingly and unlawfully being in possession of marijuana. 5. POSSESSION OF A LICENSE WHEN PRIVILEGES ARS REVOKED 6. FAILURE TO SURRENDER REVOKED OPERATORS LICENSE.

The Grand Jury charges that on or before May 8, 2017 the defendant acting alone or in complicity with others committed The offense of TRAFFICKING IN A CONTROLLED SUBSTANCE in the 1st degree first offense, METHAMPHETAMINE /FIREARM ENHANCEMENT (class B felony) by knowingly and unlawfully being in possession of a controlled substance with the intent or by trafficking in that controlled substance, namely methamphetamine, while he/she was in possession of a Taurus brand 9 mm handgun. The defendant was also indicted on operating a motor vehicle under the influence of alcohol/drugs first offense within five years for knowingly and unlawfully operating a motor vehicle while under the influence of alcohol/drugs.

The Grand Jury charges that on or before May 31st , 2017 the defendant acting alone or in complicity with others committed The offense of TRAFFICKING IN A CONTROLLED SUBSTANCE in the 1st degree first offense (class C felony) by knowingly and unlawfully being in possession of a controlled substance with the intent or by trafficking in that controlled substance, namely methamphetamine, while he/she was in possession of a Taurus brand 9 mm handgun.

Ashley Horn, 27 of Louisa, KY. The Grand Jury charges that on or May 8th, 2017 the defendant acting alone or in complicity with others committed the offense of TRAFFICKING IN A CONTROLLED SUBSTANCE in the first offense by knowingly and unlawfully being in possession of methamphetamine with the intent to traffic. The defendant committed the offense of TAMPERING WITH PHYSICAL EVIDENCE (class D felony) by knowingly and then lawfully defacing, destroying, altering or concealing evidence in which she believed would be presented and used against her and an official proceeding. The defendant The defendant committed the offense of POSSESSION/USE OF DRUG PARAPHERNALIA (by knowingly and unlawfully possessing to syringe is, scales and baggies. committed POSSESSION/USE OF DRUG PARAPHERNALIA by knowingly and unlawfully possessing 2 syringes, scales and baggies. The defendant committed the offense of public intoxication excluding alcohol by knowingly and unlawfully being manifestly under the influence of a controlled substance or other drugs in a public setting.

 

 

 

 

 

Brianna Kimble, 31 of Louisa, KY. The Grand Jury charges that on or before May 31, 2017 the defendant acting alone or in complicity with Tyler Branham committed the offense of POSSESSION OF A CONTROLLED SUBSTANCE (class D felony) in the 1st° by knowingly and unlawfully being in possession of a controlled substance, Methamphetamine. The defendant committed the offense of USE/POSSESSION OF DRUG PARAPHERNALIA IN THE 1ST° by knowingly and unlawfully being in possession of three syringes.

 

 

 

 

 

Tyler L. BranhamTyler Branham, 34 of Louisa, KY. Indicted on 1. FLEEING AND EVADING POLICE ON FOOT, 1st degree (class D felony)

The grand jury charges that on or before May 31, 2017 the defendant knowingly and unlawfully with the intent to elude or flee as a pedestrian, disobeyed commands and orders to stop given by officers with the Louisa Police Department, creating a substantial risk or serious injury or death to any person or property. 2. PERSISTENT FELONY OFFENDER, Having been charged in this indictment with above stated crime and he is now being charged as a persistent felony offender in the 1st degree for the reason that the defendant now more than 21 years of age, was previously convicted of two prior felony charges. 3. POSSESSION OF A CONTROLLED SUBSTANCE IN THE 1ST/COMPLICITY (class D felony) The defendant acting alone or in complicity with Breanna Kimbler committed the offense by knowingly and unlawfully possessing a controlled substance, methamphetamine. 4. DEFENDANT CHARGED ON FAILURE OF OWNER TO MAINTAIN REQUIRED INSURANCE/SECURITY. 5. THE DEFENDANT KNOWINGLY AND UNLAWFULLY OPERATING A MOTOR VEHICLE WHILE HE DID NOT POSSESS AN OPERATOR’S LICENSE. 6. The defendant knowingly and unlawfully operating a motor vehicle without a registration receipt. 7. The defendant knowingly and unlawfully operated a motor vehicle without the use of proper safety belts. 8. The defendant knowingly and unlawfully being in a motor vehicle while in possession of an open alcohol container.

The grand jury charges that from or about April 14, 2017 the defendant committed the offense of CRIMINAL POSSESSION OF A FORGED INSTRUMENT IN THE 2nd degree (class D felony) by knowingly and unlawfully with the intent to defraud, deceive or injure another, letters or possesses a fraudulent or forged check drawn that she passed at Food City of Louisa Kentucky in the amount of $75 with the intent to defraud Florene Hampton of Louisa, Kentucky

 

 

 

 

 

 

Tyler BurchettTyler Burchett, 23 of Louisa, KY. The grand jury charges that on or before May 24, 2017 the defendant committed the offense of 1. TAMPERING WITH PHYSICAL EVIDENCE (class D felony) by knowingly and unlawfully destroying, mutilating, concealing, removing or altering any physical evidence which one believes is about to be used in an official proceeding against him. The defendant acting alone or in complicity with Michael Wilks committed the offense of 2. UNLAWFUL POSSESSION OF A METHAMPHETAMINE PRECURSOR , 1st degree (class D felony) by knowingly and unlawfully possessing a drug product, where are possessing a combination of drug products containing Pseudoephedrine, namely 14.4 g of pseudoephedrine, with the intent to use the drug product or a combination of drug products as a precursor to manufacturing methamphetamine or other controlled substance. The defendant acting alone or in complicity with Michael Wilkes committed the offense of 3. POSSESSION OF A CONTROLLED SUBSTANCE IN THE 1st degree (class D felony) by knowingly and unlawfully possessing a controlled substance, methamphetamine. The defendant acting alone or in complicity with Michael Wilkes committed the offense of 4. POSSESSION/USE OF DRUG PARAPHERNALIA by knowingly and unlawfully being in possession of a set of scales, altered straws and pencils, spoons and a syringe. The defendant acting alone or in complicity with Michael Wilkes committed the offense of 5. POSSESSION OF MARIJUANA by knowingly and unlawfully possessing 11.7 g of marijuana.

TAMPERING WITH PHYSICAL EVIDENCE (class D felony) by knowingly and unlawfully destroying, mutilating, concealing, removing or altering any physical evidence which one believes is about to be used in an official proceeding against him. The defendant acting alone or in complicity with Tyler Burchette committed the offense of 2. Indicted on TRAFFICKING IN A CONTROLLED SUBSTANCE 2nd DEGREE (class D felony) The Grand Jury charges that on or before September 12, 2017 the defendant acting alone or in complicity with Broderick Cyrus committed the offense by knowingly and unlawfully being in possession of a schedule III controlled substance with the intent to traffic in that controlled substance, Suboxone or by trafficking in that controlled substance.

Thomas J. DaltonThomas Dalton, Jr., 35 of Louisa, KY. The grand jury charges that on or before October 11, 2015 the defendant committed the offense of SEXUAL ABUSE IN THE 1st degree (class C felony) by knowingly and unlawfully subjecting a child less than 12 years of age to sexual contact by digital penetration. The defendant having been charged in this indictment with the above stated felony count, is now being charged as a PERSISTENT FELONY OFFENDER.

 

 

 

 

 

Steven Prater, 48 of Ulysses, KY. Indicted on RAPE IN THE 2nd degree (class C felony), 5 counts of RAPE IN THE 3rd degree (Class D felonies), SODOMY IN THE SECOND DEGREE (class C felony), 5 COUNTS OF SODOMY IN THE 3rd DEGREE (class D felony) AND 10 COUNTS OF SEXUAL ABUSE IN THE 1ST Degree, (class D felonies).

The grand jury charges that on or before January 1, 2009 through October 14, 2014 the defendant committed the offense of right in the 2nd degree by being 18 years old or older, knowingly and unlawfully engaging in sexual intercourse with a victim under the age of 14 years old. The defendant knowingly and unlawfully engaged in sexual intercourse with a victim under the age of 18 years old while being a person in a position of authority/special trust and coming into contact with said minor child as a result of said position. The defendant knowingly and unlawfully subjecting a victim and do the age of 18 years old to sexual contact in the form of digital penetration, fondling, and/or object penetration while being a person in a position of authority/special trust and coming into contact with said minor child as a result of said position. All together Mr. Prater is facing 22 sex crimes. (See separate Lazer story on main page)

An indictment is not proof of guilt or innocence but is a charge that there is enough evidence to bring the person to trial.
