Tri-State Medical clinic pill scam began in 2010, grand jury charges

 

The Lawrence County Grand Jury met on Thursday, August 12th returning with 12 Indictments. Sexual Activity with a Minor being at the top of the list. Audrey Horn of Louisa, Ky. could be facing up to 25 years for unlawful transactions with a child under the age of 16 while giving the child marijuana. Three of the indictments stemming from the Tri-State Medical Clinic being busted just days ago.

Audrey HornAudrey Horn, 27 of Louisa was indicted Unlawful Transaction in the 1st Degree (Victim less than 16 yrs. of age) a Class B Felony with a penalty of 10 to 20 years, and Unlawful Transaction In the 2nd Degree (Victim less than 16 years of age) a Class D Felony with a penalty of 1 to 5 years.

The Grand Jury Charges that on or about March 1st, 2016 through April 8th, 2016 the above named defendant committed the offense by knowingly and unlawfully inducing, assisting, or causing a minor, a juvenile child less than 16 of age to engage in illegal sexual activity. The defendant also knowingly and unlawfully induced, assisted or caused a minor or juvenile child less than 16 years of age to engage in illegal controlled substance activity, marijuana.

DR. Alfred BalderaAlfred Baldera, 64 of Ona, WV. Indicted on 2 counts of Kentucky Medical Assistance Program Fraud of $300 or more/ Complicity a Class D Felony (1 to 5) years on both counts, Forgery of a Prescription 1st Offense/Complicity, Class D Felony (1 to 5) years. Dispense/Prescribe/Administer Controlled Substance, a Class D Felony (1 to 5) years, and Wrongfully Filling Prescriptions, 1st offense, a Class A Misdemeanor carries a sentence of Up to 12 months.

The Grand Jury Charges (1) on or about February 19th 2010 through on or about April 19th, 2013 in Lawrence Co. Ky., that the above named defendant, acting alone or in complicity with Kevin Gauze and/or another or others, knowingly or wantonly devised a scheme and/or planned a scheme or artifice and/or entered into an agreement, combination, or conspiracy to obtain payments valued at $300. Or more from the Kentucky Medical Assistant Program (KMAP) by means of any fictitious, false, or fraudulent applications, claim, report, or document submitted to the Cabinet for Health and Family Services, and/or he intentionally engaged in conduct which advanced the scheme or artifice. (2) From on or about January 4, 2016 through on or about June 21, 2016 in Lawrence County, KY. The above named defendant, acting alone or in complicity with Kevin Gauze, and/or another or others, knowingly or wantonly devised a scheme and/or planned a scheme or artifice and/or entered into an agreement, combination, or conspiracy to obtain payments valued at $300. Or more from the KMAP by means of any fictitious, false, or fraudulent application, claim, report or document submitted to the Cabinet for Health and Family Services and/or he intentionally engaged in conduct which advanced the scheme or artifice. (3) From June 11th, 2015 through June 21, 2016 in Lawrence County Ky. The above named defendant, acting alone or in complicity with Kevin Gauze, and/or another or others with the intent to defraud, deceive, or injure another, he falsely made, completed, or altered a written instrument which is or purports to be or which is calculated to become or represent a prescription for a controlled substance when completed.(4) From on or about January 4, 2016 through on or about June 21, 2016 in Lawrence Co. Ky. The above named defendant, acting alone or in complicity with Kevin Gauze, and/or another or others, dispensed, prescribed, distributed, or administered a controlled substance which was not authorized by law. (5) From on or about January 4th, 2016 through on or about June 21st, 2016 In Lawrence Co. Ky. The above named defendant, acting alone or in complicity with Kevin Gauze, and/or another or others signed prescriptions prior to the date that the prescriptions were issued. AGAINST THE PEACE AND DIGNITY OF THE COMMONWEALTH OF KENTUCKY.

Janice GauzeJanice Gauze, 46 of Louisa, Kentucky was indicted on the charge of Unauthorized Procurement of Controlled Substance a Class D Felony that has a penalty of 1 to 5 years.

The Grand Jury charges that in Lawrence County, Ky. on or about January 15, 2016 through on or about March 8, 2016 the above named defendant acting alone or in complicity with another or others, knowingly made a false statement regarding a prescription and/or for the purpose of obtaining a controlled substance presented a prescription for a controlled substance that was obtained in violation of KRS 218A.

Kevin GauzeKevin Gauze, 47 of Louisa, KY. Indicted on 2 counts of Kentucky Medical Assistance Program Fraud of $300 or more/ Complicity, both Class D Felonies (1 to 5) years, Forgery of a Prescription 1st Offense/Complicity, a Class D Felony (1 to 5) years, Dispense/Prescribe/Administer Controlled Substance, Class D Felony (1 to 5) years, Wrongfully Filling Prescriptions, 1st offense a Class A Misdemeanor that carries a sentence of Up to 12 Months, and Unauthorized Procurement of a Controlled Substance, a Class D Felony ( 1 to 5) years.

(3) From June 11th, 2015 through June 21, 2016 in Lawrence County Ky. The above named defendant, acting alone or in complicity with Alfred Baldera, and/or another or others with the intent to defraud, deceive, or injure another, he falsely made, completed, or altered a written instrument which is or purports to be or which is calculated to become or represent a prescription for a controlled substance when completed.(4) From on or about January 4, 2016 through on or about June 21, 2016 in Lawrence Co. Ky. The above named defendant, acting alone or in complicity with Alfred Baldera, and/or another or others, dispensed, prescribed, distributed, or administered a controlled substance which was not authorized by law. (5) From on or about January 4th, 2016 through on or about June 21st, 2016 In Lawrence Co. Ky. The above named defendant, acting alone or in complicity with Alfred Baldera, and/or another or others signed prescriptions prior to the date that the prescriptions were issued. (6) From on or about January 8, 2016 through on or about March 16, 2016 in Lawrence Co. KY. The above named defendant alone or acting in complicity with another and/or others, knowingly made a false statement regarding a prescription; and/or represented himself to be a practitioner, or other authorized person for the purpose of obtaining in violation of KRS 218A.

David A. VanceDavid Vance, 42 of Louisa, KY. Indicted on the following charges: Cultivating Marijuana (More than 5 plants) a Class D Felony (1 to 5) years penalty . Possession A Controlled Substance in The 1st Degree, a Class D Felony (1 to 5) years, Tampering With Physical Evidence, Class D Felony (1 to 5) years, Operating A Motor Vehicle Under The Influence of Alcohol /Drugs 1st Offense, a Misdemeanor with a penalty of not more than 12 months. Criminal Trespass In The Third Degree, a violation.

The Grand Jury Charges that on June 16th, 2016 in Lawrence Co. KY. David Vance acting alone or in complicity with Michael Wilks committed the offense of Cultivating Marijuana Over Plants when they knowingly and unlawfully cultivated over 5 plants. Defendant Committed the offense of Possession of a Controlled Substance in the First Degree by knowingly and unlawfully being in possession of a schedule II controlled substance, namely Hydrocodone. Defendant knowingly and unlawfully destroyed, defaced or concealed physical evidence that he believed would be used against him in an official proceeding, he was operating a vehicle while under the influence of Alcohol /Drugs that impair a driver’s ability to operate a motor vehicle and knowingly and unlawfully entered or remained upon the premises owned by Mrs. Nadine Kelly.

Michael WilksMichael Wilks, 40 of Louisa, KY was indicted on the following charges: Cultivating Marijuana (More than 5 Plants) Class D Felony (1 to 5) years penalty by acting alone or in complicity with David Vance committing the offense by knowingly and unlawfully cultivating over 5 plants. Persistent Felony Offender in the First Degree, An Enhancement. Fleeing and Evading Police in the 2nd Degree, On Foot by knowingly and unlawfully failing to obey any verbal and visible signs to stop given by deputies with the Lawrence County Sheriff’s Dept. in an attempt to flee from arrest, a Class A Misdemeanor with a Penalty of no more than 12 months. Defendant committed the offense of Possession/Use Drug Paraphernalia by knowingly and unlawfully being in possession of altered pipe containing residue. Above named defendant committed the offense of Criminal Trespass, a violation by knowingly and unlawfully entered or remained upon the premises owned by Mrs. Nadine Kelly.

Clarence EarleClarence C. Earle, 51 of Louisa, KY. Was indicted on charges of Trafficking In A Controlled Substance 2nd Degree, less than (20) dosage Units With a Firearm Enhancement (Class C Felony) 5 to 18 years. Possession of A Controlled Substance In the 1st Degree (2 Counts)/Complicity (Class D Felony) 1 to 5 years, Knowingly/Fraudulently Use ID Card or Electronic Benefits (Class D Felony) 1 to 5 years and Possession of Drug Paraphernalia/Complicity.

The above stated defendant acting alone or in complicity with James Mullett, Christopher Mullett and Debra Earle committed the offense by knowingly and unlawfully being in the possession of a schedule III Controlled Substance, Soboxone, while being in possession of (2) .22 Caliber handguns. He acted alone or in complicity with Christopher and James Mullett and Debra Earle Possessed a schedule II controlled substance, namely oxycodone, a schedule II controlled substance, namely Hydrocodone. Defendant with Co-defendants are charged with misappropriating or attempting to misappropriate a food stamp authorization to purchase card, food stamp card or misappropriate other benefits from program with which the person has been assigned responsibility, nor shall the person knowingly fail to report any of these activities. Defendant was in possession of a altered straw with chemical residue and an altered pen with chemical residue, and possessed (9) syringes.

Debra Earle, 59 of Louisa wife of Clarence Earle Was indicted on charges of Trafficking In A Controlled Substance 2nd Degree, less than (20) dosage Units With a Firearm Enhancement (Class C Felony) 5 to 18 years. Possession of A Controlled Substance In the 1st Degree (2 Counts)/Complicity (Class D Felony) 1 to 5 years, Knowingly/Fraudulently Use ID Card or Electronic Benefits (Class D Felony) 1 to 5 years and Possession of Drug Paraphernalia/Complicity.

The above stated defendant acting alone or in complicity with James Mullett, Christopher Mullett and Clarence Earle committed the offense by knowingly and unlawfully being in the possession of a schedule III Controlled Substance, Soboxone, while being in possession of (2) .22 Caliber handguns. He acted alone or in complicity with Christopher and James Mullett and Clarence Earle Possessed a schedule II controlled substance, namely oxycodone, a schedule II controlled substance, namely Hydrocodone. James MullettJames Mullett, 33 of Louisa  Was indicted on charges of Trafficking In A Controlled Substance 2nd Degree, less than (20) dosage Units With a Firearm Enhancement (Class C Felony) 5 to 18 years. Possession of A Controlled Substance In the 1st Degree (2 Counts)/Complicity (Class D Felony) 1 to 5 years, Knowingly/Fraudulently Use ID Card or Electronic Benefits (Class D Felony) 1 to 5 years and Possession of Drug Paraphernalia/Complicity.

The above stated defendant acting alone or in complicity with Clarence Earle, Christopher Mullett and Debra Earle committed the offense by knowingly and unlawfully being in the possession of a schedule III Controlled Substance, Soboxone, while being in possession of (2) .22 Caliber handguns. He acted alone or in complicity with Clarence Earle, Christopher Mullett and Debra Earle Possessed a schedule II controlled substance, namely oxycodone, a schedule II controlled substance, namely Hydrocodone. Defendant with Co-defendants are charged with misappropriating or attempting to misappropriate a food stamp authorization to purchase card, food stamp card or misappropriate other benefits from program with which the person has been assigned responsibility, nor shall the person knowingly fail to report any of these activities. Defendant was in possession of a altered straw with chemical residue and an altered pen with chemical residue.

Christopher Mullett Christopher Mullett, 38 of Louisa has been charged by the Grand Jury with the following: Defendant acting alone or in complicity with Clarence Earle, Debra Earle and James Earle committed the offense of Trafficking in a Controlled Substance in the 2nd Degree by knowingly and unlawfully being in possession of a schedule III controlled substance with the intent to traffic in that drug while being in the possession of two .22 caliper handguns. Defendant is charged with Possession of a Controlled Substance, 1st Degree by knowingly and unlawfully being in possession of a schedule II controlled substance, namely Oxycodone, Possession of a Controlled Substance in the 1st Degree by knowingly and unlawfully possessing a schedule II controlled substance, Hydrocodone. Defendant is also charged with Fraudulent Use of an EBT Card by knowingly and unlawfully misappropriating or attempting to misappropriate a food stamp authorization to purchase card, food stamp identification card or a Medicaid Identification card or misappropriate other benefits from any program with which the person has been assigned responsibility, without person reporting any of these activities. The defendant with co-defendants is also charged with Possession/Use Drug Paraphernalia by being in possession of an altered straw with chemical residue. Defendant is charged separately for Tampering With Physical Evidence (Class D Felony) 1 to 5 year penalty for knowingly and unlawfully destroying, altering or concealing physical evidence that he felt would be used against him in an official proceeding.

Alexis J. BoydAlexis Boyd, 22 of Louisa has been indicted on the charges of Possession of Controlled Substance, 1st Degree/ Complicity (Class D Felony) 1 to 5 year penalty, by acting alone or in complicity with Matthew Caudill and  knowingly and unlawfully being in possession of Methamphetamine, Use/Possession Of Drug Paraphernalia/Complicity by unlawfully being in possession of a broken glass vessel containing chemical residue, Bail-jumping In The 1st Degree (Class D Felony) penalty 1 to 5 years for knowingly and unlawfully having been released from custody by the court, with or without bail, upon condition that she will subsequently appear at a specified time and place in connection with a felony charge of Possession of Controlled Substance in the 1st Degree, a Class D Felony, she failed to appear in the 1st Degree at the time and place ordered by the court.

Matthew Caudill Matthew Caudill, 34 of Louisa was indicted on the charges of Possession of A Controlled Substance 1st Degree/Complicity (Class D Felony) Carries 1-5 years and Use/Possession of Drug Paraphernalia 1st Degree/Complicity by acting alone or in complicity with Alexis Boyd and knowingly and unlawfully being in possession of a Controlled Substance, Methamphetamine and also being in possession of a broken glass vessel containing chemical residue.
